This website is operated by Piki Toi, a business based in Aotearoa New Zealand.
Throughout this website, the terms “we”, “us” and “our” refer to Piki Toi.
Piki Toi provides this website, including the information, products, digital content and services available through it, subject to these Terms of Service.
By visiting our website, placing an order, purchasing a product or otherwise using our services, you agree to these Terms of Service together with our Shipping Policy, Returns & Refunds Policy and Privacy Policy.
Please read these terms before using our website or purchasing from us.
Nothing in these Terms is intended to exclude or limit any rights that cannot lawfully be excluded under applicable consumer law.
1. Online Store
By purchasing from Piki Toi, you confirm that you are legally capable of entering into the transaction or have appropriate permission to do so.
You must not use our website, products or services for an unlawful or unauthorised purpose.
You must not attempt to interfere with the security, operation or functionality of our website or ecommerce systems.
Our online store is hosted by Shopify, which provides the ecommerce platform through which we sell our products and services.
2. Products
We offer a range of products that may include:
- physical products;
- printed products;
- card decks;
- digital downloads;
- pre-order products;
- limited-edition products; and
- custom or personalised products.
Product availability may change without notice.
We make reasonable efforts to ensure that product descriptions, photographs, colours, dimensions and other information are accurate.
However, colours may appear differently depending on your screen, device, printer, ink or paper.
Handmade, printed or manufactured products may also have minor variations that do not affect their intended use.
3. Orders
Submitting an order constitutes an offer to purchase the products in your order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- incorrect pricing or product information has been displayed;
- we suspect fraudulent or unauthorised activity;
- payment cannot be processed;
- an order breaches these Terms; or
- we are unable to fulfil the order.
If we cancel an order after payment has been received, we will provide an appropriate refund unless there is a lawful reason not to do so.
You are responsible for ensuring that the information supplied when ordering is complete and accurate.
4. Pre-Orders
Products identified as Pre-Order are purchased before they are available for immediate dispatch.
By purchasing a pre-order product, you acknowledge and agree that:
- the product will not be dispatched immediately;
- the estimated dispatch date or timeframe displayed with the product is an estimate;
- manufacturing, supplier, freight, customs or other circumstances may affect the expected dispatch timeframe; and
- delivery/transit estimates begin after the order has been dispatched, not from the date the pre-order was placed.
We will make reasonable efforts to fulfil pre-orders within the estimated timeframe and communicate significant delays where appropriate.
If you wish to request cancellation of a pre-order before dispatch, please contact us at hello@pikitoi.co.nz.
Cancellation and refund requests will be handled in accordance with our Returns & Refunds Policy and applicable consumer law.
Once a pre-order has been dispatched, it is treated as a shipped physical order.
5. Shipping & Delivery
Piki Toi is based in Aotearoa New Zealand, and physical orders are dispatched from New Zealand.
We offer domestic and selected international shipping.
Shipping and delivery timeframes displayed on our website are estimates unless expressly stated otherwise.
Processing time, pre-order waiting periods and shipping/transit time are separate.
For international customers, delivery may take longer because of international freight, customs processing, border clearance and destination-country courier or postal networks.
Piki Toi is not responsible for delays outside our reasonable control, but we will assist customers with genuine delivery issues where reasonably possible.
Customers are responsible for providing an accurate and complete delivery address.

6. Tracking & Delivery Issues
Where tracking is available, tracking details will be provided after dispatch.
Tracking information may take time to update, particularly while an international parcel is travelling between countries or undergoing customs processing.
If you believe your order is delayed, missing or has been incorrectly delivered, please contact us at hello@pikitoi.co.nz so that we can investigate the shipment.
Where tracking confirms delivery to the shipping address supplied with the order, we will ordinarily regard the order as having been fulfilled, subject to any rights you may have under applicable law.
7. Prices & Payment
Prices are displayed in the currency indicated on our website or at checkout.
Prices may change without notice, but changes will not ordinarily affect orders already accepted and paid for.
Shipping charges and any applicable taxes or fees will be displayed at checkout where available.
International customers may also be responsible for customs duties, import taxes or other charges imposed by their country.
Payment must be successfully authorised before an order can be processed.
8. Payment Disputes & Chargebacks
If you have a concern about an order, including a delayed or missing delivery, incorrect product or payment issue, we encourage you to contact us first at hello@pikitoi.co.nz so we have an opportunity to investigate and resolve the matter.
Nothing in these Terms prevents a customer from exercising a legitimate right to dispute a transaction through their bank, card issuer or payment provider.
If a payment dispute or chargeback is initiated, however, Piki Toi may provide relevant evidence to the payment processor, card network or financial institution considering the dispute.
This may include:
- transaction and order information;
- product descriptions;
- evidence that a product was sold as a pre-order;
- the applicable estimated dispatch timeframe;
- website policies applicable to the transaction;
- customer communications;
- billing and shipping information;
- fulfilment records;
- courier and tracking information; and
- proof of delivery.
We may retain relevant transaction and fulfilment records for the purpose of responding to disputes, preventing fraud and protecting our legitimate business interests, subject to our Privacy Policy and applicable law.
9. Digital Products
Digital products are supplied electronically and no physical product will be shipped unless specifically stated otherwise.
Customers are responsible for ensuring that they have appropriate software, equipment and printing facilities where required.
Digital products are for the purchaser's permitted personal or educational use as described on the applicable product page.
Unless expressly authorised, purchasing a digital product does not transfer copyright or ownership of the underlying artwork, illustrations, designs, photographs, text or other intellectual property.
Digital products may not be reproduced for commercial resale, redistributed, uploaded to file-sharing services, resold or otherwise commercially exploited without our written permission.
Refunds for digital products are governed by our Returns & Refunds Policy and applicable consumer law.
10. Intellectual Property
Unless otherwise stated, the content of the Piki Toi website and Piki Toi products — including artwork, illustrations, designs, card designs, written content, photographs, branding, logos and digital resources — is owned by or licensed to Piki Toi and is protected by applicable intellectual-property laws.
Purchasing a Piki Toi product does not transfer ownership of our intellectual property.
You may not reproduce, copy, distribute, commercially exploit, resell or create unauthorised derivative products from Piki Toi intellectual property except where expressly permitted.
This provision does not prevent the ordinary personal use of a physical product you have purchased.
11. Digital Download Licence
Unless a product listing expressly provides a different licence, digital downloads purchased from Piki Toi are supplied for the purchaser's personal use.
Where a product is expressly sold or described for classroom or educational use, it may also be used by the purchasing educator in accordance with the licence stated with that product.
Digital files may not be:
- resold;
- redistributed;
- shared publicly;
- uploaded to shared drives or resource-sharing websites for unrestricted access;
- reproduced as products for sale; or
- commercially exploited,
unless Piki Toi has expressly authorised that use.
12. Returns, Refunds & Cancellations
Returns, refunds, exchanges and cancellations are governed by our Returns & Refunds Policy.
Nothing in these Terms or our Returns & Refunds Policy limits rights that cannot legally be excluded.
13. Accuracy of Information
We make reasonable efforts to keep information on our website accurate and current.
Occasionally there may be typographical errors, incorrect prices, availability errors or other inaccuracies.
Where permitted by law, we reserve the right to correct errors and update information.
If an error materially affects an order you have already placed, we will contact you where reasonably necessary and provide an appropriate remedy.
14. Third-Party Services
Our website may use or link to services provided by third parties, including Shopify, payment providers, social-media platforms, couriers and other service providers.
Those services may be governed by their own terms and privacy policies.
Piki Toi is not responsible for the independent operation of third-party websites or services outside our reasonable control.
15. Reviews, Feedback & User Content
If you voluntarily submit a review, testimonial, photograph or other content to Piki Toi for publication, you confirm that you have the right to provide that material.
We may display genuine customer reviews and feedback in connection with Piki Toi, subject to applicable privacy and consumer laws.
We reserve the right to remove unlawful, abusive, fraudulent, misleading or otherwise inappropriate content from areas of our website that we control.
16. Prohibited Use
You must not use our website or services to:
- engage in unlawful activity;
- infringe our intellectual-property rights or those of another person;
- submit fraudulent or deliberately misleading information;
- transmit malicious software;
- attempt to gain unauthorised access to our systems;
- scrape or harvest personal information unlawfully; or
- interfere with the operation or security of the website.
17. Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded.
For New Zealand consumers, this includes applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
Where another country's mandatory consumer protection laws apply to an international transaction, nothing in these Terms is intended to exclude rights that cannot legally be excluded under those laws.
18. Limitation of Liability
To the maximum extent permitted by law, Piki Toi will not be liable for indirect or consequential loss arising from the use of our website, products or services where that liability can lawfully be excluded.
Nothing in this section limits liability or consumer remedies that cannot legally be excluded or limited.
19. Privacy
Personal information provided through our website is handled in accordance with our Privacy Policy.
This includes information collected in connection with purchases, shipping, customer service, fraud prevention and transaction disputes.
20. Changes to These Terms
We may update these Terms periodically to reflect changes to our products, services, business practices or legal obligations.
Changes will apply from the date the revised Terms are published and will not retrospectively alter rights and obligations relating to completed transactions where doing so would be unlawful.
21. Governing Law
These Terms are governed by the laws of New Zealand, subject to any mandatory consumer protections that may apply to customers in other jurisdictions.
The old policy already specified New Zealand law, so I would retain that rather than attempting to make US law govern your American orders.
